1. Scope and Definitions

1.1 Scope

These Terms of Service ("Terms") govern your use of the MatchMyMeal mobile application ("App") and related services ("Services") provided by Henrik Dymke, Einzelunternehmen, Schneeglöckchenstrasse 13, 10407 Berlin, Germany ("we", "us", "our", or "MatchMyMeal").

1.2 Definitions

  • "App" means the MatchMyMeal mobile application available on iOS and, in the future, Android platforms.
  • "Services" means all features, functionality, and content provided through the App, including but not limited to meal planning, recipe suggestions, grocery list generation, and subscription services.
  • "User" or "you" means any individual who accesses or uses the App.
  • "Account" means your registered user account with MatchMyMeal.
  • "Subscription" means a paid subscription plan providing access to premium features of the App.
  • "Content" means all text, graphics, images, recipes, meal plans, and other materials available through the App.

1.3 Acceptance

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1.4 Age Requirement

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age.

1.5 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the App at least 10 days before such changes take effect. Your continued use of the App after the effective date of the changes constitutes acceptance of the modified Terms.

2. Account Registration

2.1 Account Creation

To use certain features of the App, you must create an Account by providing:

  • A valid email address
  • A secure password
  • Any other information requested during registration

You may also register using third-party authentication services (Apple, Google) as provided by the App.

2.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your Account credentials
  • You are responsible for all activities that occur under your Account
  • You must immediately notify us at hello@matchmymeal.app of any unauthorized use of your Account
  • You must provide accurate, current, and complete information during registration and keep such information updated

2.3 Account Security

We are not liable for any loss or damage arising from your failure to maintain the security of your Account. You agree not to share your Account credentials with any third party.

2.4 Account Termination

You may delete your Account at any time through the App settings or by contacting us at hello@matchmymeal.app. We reserve the right to suspend or terminate your Account if you violate these Terms.

3. Description of Services

3.1 Service Features

MatchMyMeal provides a meal planning service that:

  • Allows users to swipe through meal suggestions to indicate preferences
  • Automatically generates personalized weekly meal plans based on user preferences
  • Creates grocery lists based on selected meal plans
  • Provides recipe information, including ingredients, preparation time, and difficulty levels
  • Stores user preferences, dietary restrictions, and meal history

3.2 Content Source

All meal suggestions, recipes, and related content are generated using artificial intelligence. We do not guarantee the accuracy, completeness, or safety of any recipe or meal suggestion. Users are responsible for verifying recipe information and following food safety guidelines.

3.3 Service Availability

  • We strive to provide continuous access to the Services but do not guarantee uninterrupted or error-free operation
  • The Services may be temporarily unavailable due to maintenance, updates, or technical issues
  • We reserve the right to modify, suspend, or discontinue any part of the Services at any time
  • We are not liable for any loss or inconvenience resulting from Service unavailability

3.4 No Medical or Nutritional Advice

The Services do not provide medical, nutritional, or dietary advice. The meal suggestions and recipes are for informational purposes only and are not intended to:

  • Diagnose, treat, cure, or prevent any disease
  • Replace professional medical or nutritional advice
  • Address specific health conditions or dietary needs

You should consult with qualified healthcare professionals regarding any medical or nutritional concerns.

4. Subscription Services

4.1 Subscription Plans

MatchMyMeal offers subscription plans with the following features:

  • Monthly Subscription: Provides access to premium features on a month-to-month basis
  • Yearly Subscription: Provides access to premium features for one year, includes a 7-day free trial

Subscription prices are displayed in the App and may vary by region. All prices include applicable taxes unless otherwise stated.

4.2 Free Trial

  • The 7-day free trial is available only for yearly subscriptions
  • During the free trial, you have full access to premium features
  • If you do not cancel before the trial period ends, your subscription will automatically convert to a paid yearly subscription
  • You will be charged the full yearly subscription price at the end of the trial period
  • You may cancel the subscription at any time during the trial period through your device's subscription management settings

4.3 Subscription Management

  • Subscriptions are managed through your device's App Store (iOS) or Google Play Store (Android) account
  • Payment is processed by Apple (for iOS) or Google (for Android) in accordance with their respective terms
  • You can manage, modify, or cancel your subscription through your device's subscription settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods

4.4 Subscription Renewal

  • Monthly subscriptions automatically renew each month
  • Yearly subscriptions automatically renew each year
  • You will be charged the then-current subscription price at the time of renewal
  • We will notify you of any price changes before they take effect

4.5 Subscription Termination

  • You may cancel your subscription at any time through your device's subscription management settings
  • We may terminate your subscription if you violate these Terms
  • Upon termination, you will lose access to premium features at the end of your current billing period
  • No refunds will be provided for the remaining subscription period unless required by applicable law

5. User Obligations and Acceptable Use

5.1 Permitted Use

You may use the App solely for personal, non-commercial purposes. You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to the App or related systems
  • Reverse engineer, decompile, or disassemble any part of the App
  • Copy, modify, or create derivative works of the App
  • Use automated systems to access the App without permission
  • Interfere with or disrupt the Services or servers

5.2 User Content

While the App primarily provides AI-generated content, you may create and store:

  • Meal plans
  • Preferences and dietary restrictions
  • Meal swipe history
  • Other personal data related to your use of the App

You retain ownership of your personal data but grant us a license to use such data to provide and improve the Services.

5.3 Prohibited Activities

You agree not to:

  • Share your Account with others
  • Use the App to compete with MatchMyMeal
  • Scrape, harvest, or collect data from the App
  • Use the App in a manner that could damage, disable, or impair the Services
  • Engage in any activity that violates these Terms

6. Intellectual Property Rights

6.1 Our Rights

All intellectual property rights in the App, including but not limited to:

  • Software code
  • User interface and design
  • AI-generated meal suggestions and recipes
  • Trademarks and logos
  • Documentation

are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal devices
  • Use the App for personal, non-commercial purposes
  • Access and use the Services in accordance with these Terms

This license does not include the right to:

  • Copy, modify, or distribute the App
  • Use the App for commercial purposes
  • Remove any proprietary notices or labels

6.3 AI-Generated Content

All meal suggestions, recipes, and related content generated by our AI systems are our property. You may use such content solely for personal meal planning purposes. You may not:

  • Reproduce, distribute, or publicly display AI-generated content
  • Use AI-generated content for commercial purposes
  • Claim ownership of AI-generated content

7. Privacy and Data Protection

7.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal information.

7.2 Data Processing

We process your personal data in accordance with:

  • The European General Data Protection Regulation (GDPR)
  • The German Federal Data Protection Act (BDSG)
  • Our Privacy Policy

7.3 Third-Party Services

The App uses third-party services for:

  • Authentication (Apple, Google)
  • Subscription management (RevenueCat, Apple App Store, Google Play Store)
  • Analytics (PostHog)
  • Backend services (Supabase)

These services may collect and process your data in accordance with their respective privacy policies.

8. Warranties and Disclaimers

8.1 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF CONTENT

8.2 Recipe and Meal Content

We do not warrant that:

  • Recipes are accurate, complete, or safe
  • Meal suggestions are suitable for your dietary needs or health conditions
  • Ingredients are available or correctly listed
  • Preparation instructions are error-free
  • Nutritional information is accurate

You are responsible for:

  • Verifying recipe information
  • Following food safety guidelines
  • Checking for allergens and dietary restrictions
  • Consulting healthcare professionals for dietary advice

8.3 Service Availability

We do not warrant that:

  • The Services will be uninterrupted or error-free
  • Defects will be corrected
  • The Services are free from viruses or harmful components

9. Limitation of Liability

9.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR USE
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES

9.2 Maximum Liability

Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid for the Services in the 12 months preceding the claim, or €50, whichever is greater.

9.3 Exceptions

The limitations above do not apply to:

  • Liability for death or personal injury caused by our negligence
  • Liability for fraud or fraudulent misrepresentation
  • Liability that cannot be excluded under applicable law

9.4 Food Safety Disclaimer

We are not liable for:

  • Any illness, injury, or adverse health effects resulting from following recipes or meal suggestions
  • Allergic reactions or food-related incidents
  • Incorrect ingredient information or preparation instructions
  • Food safety issues arising from recipe preparation

You use recipes and meal suggestions at your own risk.

10. Indemnification

You agree to indemnify, defend, and hold harmless MatchMyMeal and its owner from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your use of the Services at any time by:

  • Deleting your Account through the App settings
  • Uninstalling the App
  • Contacting us at hello@matchmymeal.app

11.2 Termination by Us

We may terminate or suspend your access to the Services immediately, without prior notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • We are required to do so by law
  • We discontinue the Services

11.3 Effect of Termination

Upon termination:

  • Your right to use the Services immediately ceases
  • Your Account and associated data may be deleted
  • You will lose access to premium features
  • Provisions that by their nature should survive termination will remain in effect

12. Right of Withdrawal (Widerrufsrecht)

12.1 Right of Withdrawal for Consumers

If you are a consumer (Verbraucher) within the meaning of German law, you have the right to withdraw from the subscription contract within 14 days without giving any reason.

12.2 Withdrawal Period

The withdrawal period expires 14 days after the day on which the subscription contract is concluded.

12.3 Exercise of Withdrawal Right

To exercise your right of withdrawal, you must inform us of your decision to withdraw by:

You may use the withdrawal form template provided below, but it is not mandatory.

12.4 Effects of Withdrawal

If you withdraw from the contract:

  • We will reimburse all payments received from you without undue delay and no later than 14 days after we receive your withdrawal notice
  • Reimbursement will be made using the same means of payment you used for the initial transaction
  • You will lose access to premium features immediately upon withdrawal

12.5 Loss of Withdrawal Right

Your right of withdrawal expires if:

  • We have begun providing the digital content (premium features) with your express prior consent
  • You have acknowledged that you will lose your right of withdrawal once we begin providing the service
  • The service has been fully performed

By subscribing and using premium features, you acknowledge that you lose your right of withdrawal once we begin providing the subscription service.

13. Dispute Resolution

13.1 Applicable Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.

13.2 Jurisdiction

For consumers (Verbraucher):

  • If you are a consumer resident in Germany, disputes shall be subject to the jurisdiction of the courts of your place of residence
  • If you are a consumer resident in the EU, you may also bring proceedings in the courts of your country of residence

For businesses:

  • All disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany

13.3 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr/. We are not obligated to participate in alternative dispute resolution procedures, but we are willing to resolve disputes amicably.

13.4 Consumer Arbitration

If you are a consumer, you have the right to submit a complaint to a consumer arbitration board. We are not obligated to participate in consumer arbitration, but we are willing to consider such proceedings.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MatchMyMeal regarding the use of the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or technical failures.

These Terms are provided in English. If a German translation is provided, the English version shall prevail in case of any discrepancies.
